General terms and conditions for online sales 1. Subject These general conditions define the rights and obligations of the parties in the context of online reservations for services offered by Domaine la Fontaine. They apply to all reservations made online through our reservation platform. The client acknowledges having read and accepted these general terms and conditions of sale and any rate-specific sales conditions available on our booking platform. 2. Reservation The customer chooses the services offered on our reservation platform. He acknowledges having read the nature, destination and booking methods of the services available on our booking platform and having requested and obtained the necessary and/or additional information to make his booking in full knowledge of the facts. The customer is solely responsible for his choice of services and their suitability for his needs, so we cannot be held responsible in this respect. By going through and completing the entire process, the customer accepts his reservation. Requests made by telephone are for information purposes only and are in no way binding. If the reservation requires an advance payment, the reservation will only become final after receipt of the corresponding sum on our bank account IBAN: FR76 1170 6310 0956 0281 9210 556 - BIC / SWIFT: AGRIFRPP817 in the name of Domaine la Fontaine. If we do not receive the deposit within 7 calendar days after the reservation, Domaine la Fontaine reserves the right to cancel the agreement unilaterally. 3. Booking process The client shall make a reservation by filling out the form on our online booking platform. The reservation is considered to be made upon receipt of the booking confirmation. The customer undertakes to fill in the requested information accurately and truthfully. After the final selection of the desired services, the customer fills in a valid bank card number as guarantee and for the payment of any deposit. The customer may consult the general (and possibly specific) terms and conditions of sale before validating the reservation. Finally, the customer validates the reservation. 4. Acknowledgement of receipt of the reservation Our reservation platform confirms receipt of the customer's reservation by sending an email by return. This confirmation of receipt of the reservation includes a summary of the reserved services with their prices, these general (and possibly specific) terms and conditions of sale, the reservation date and any necessary contact information for reaching us if necessary. 5. Cancellation or modification by the customer Customers are reminded that, in accordance with Article L. 121-21-8 12 ° of the French Consumer Code, they do not have a right of withdrawal as described in this article. Cancellations can be made free of charge up to 120 days prior to arrival. For cancellations between 120 and 28 days prior to arrival, 50% of the total rental price will be charged. In the event of cancellation within 28 days of arrival, the total rental price will be charged. In the case of a shortened stay, the total price of the booked period will be charged. Where possible, we will attempt to rent out the accommodation. In that case an amount may be refunded to the tenant, but never more than 50% of the rent. The specific sales conditions of the reserved rate always take precedence over the general conditions for cancellation and/or modification of the reservation. We advise you to take out travel and cancellation insurance. If the customer should not be able to travel due to Covid-19, he may move his reservation to another period free of charge, taking into account the availability. Paid advances move along. If re-scheduling is not possible, the advance payment can be refunded with deduction of an administration cost of 50 euro. Gift vouchers are not refundable. Any cancellations or changes can only be requested by e-mail to info@domainelafontaine.com. Domaine la Fontaine will confirm receipt of any cancellation or change request by e-mail. All bookings are personal and can only be transferred to a third party with the consent of Domaine la Fontaine. 6. Use of the service In accordance with French regulations, the client may be asked to fill out a "fiche de police" on arrival and to show his/her identity card for verification. Acceptance of these general terms and conditions also implies that the customer accepts the internal regulations and undertakes to comply with them. Any behaviour contrary to these rules and regulations, to good morals and to public order may lead the establishment to ask the client to leave Domaine la Fontaine without any compensation or reimbursement if a payment has already been made. Pets are allowed only after prior consultation and agreement. 7. Liability The photos presented on our booking platform are not contractually binding. Although we do our utmost to ensure that the photos, graphics and texts give the best possible impression of our domain and the services offered, variations may occur between the time of booking and the actual use of the service. Domaine la Fontaine cannot be held responsible for failure to honour the booking or for failure to honour the booking properly in the event of force majeure attributable to a third party or to the client, in particular the unavailability of the Internet network, the impossibility of accessing the website, external intrusions, computer viruses, or in the event of advance payment not authorised by the bank of the bearer. Any reservation or payment that is irregular, non-functional, incomplete, or fraudulent for any reason attributable to the client will result in the cancellation of the order at the client's expense, without prejudice to any civil or criminal action against the client. Domaine la Fontaine cannot be held responsible for any loss, theft, accident, damage or injury caused to - or by - the renters or their possessions, either inside or outside our facilities. 8. Complaints If for any reason you are dissatisfied, we ask you to report this as soon as possible. We will do everything in our power to satisfy you. In the unlikely event that we are unable to reach an agreement, you may lodge a written complaint within eight days of the date of departure. 9. Prices The prices relating to the reservation of services are indicated in euros before and during the reservation and are valid only for the period indicated. Our company is not subject to VAT. Unless otherwise stated on the booking platform, additional services and taxes are not included in the price. They must be paid on site and will be settled at the end of your stay. Any change or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices shown on the invoice. 10. Payment The customer shall provide, via secure access (SSL encryption), his bank card details (card number without spaces between figures, expiry date - the bank card used must be valid at the time of consumption of the service - and CVC code) as a guarantee for the reservation and possibly as payment of a deposit, according to the possibilities offered by the reservation platform. He/she will check in using the bank card used to guarantee the reservation. The balance is payable on the spot and will be settled at the end of your stay, preferably in cash, together with any extras (food, drinks, etc.). We do not accept cheques, but we do accept bank or credit cards. In case of no-show (booking not cancelled - customer not present) of a booking guaranteed by credit card, Domaine la Fontaine will debit the full amount of the booking. The booking platform has chosen Stripe to secure online credit card payments. The validity of the client's payment card is verified by this organisation. The payment card may be refused for various reasons: stolen card, card blocked, limit reached, input error, etc. In the event of a problem, the customer must contact his bank to confirm the reservation and payment method. In the case of a rate requiring online payment in advance, the deposit will be debited at the time of booking. 11. Respect for privacy On each of the forms used to collect personal data, the customer is informed of the mandatory or optional nature of the answers by the presence of an asterisk. The information processed is intended for the institutions, elloha.com, its entities, its partners, its service providers (and in particular, online payment providers). The customer authorises elloha.com to communicate his/her personal data to third parties on the condition that this communication proves to be compatible with the execution of operations carried out on elloha.com under the present general conditions and in relation to the Customer Protection Charter. In particular, when paying online, the customer's bank details must be sent to Domaine la Fontaine's bank for the execution of the reservation contract. The customer consents to this transfer which is necessary for the execution of his/her reservation. Constellation SAS, in their professional capacity, are obliged to take all security measures and respect the confidentiality of data for the aforementioned transfers. If, during your stay, we have taken photos or videos in which you are visible, we may use these images for promotional purposes. If you do not wish this to happen, please let us know at the latest when you leave. You have the right to access and correct your personal data. 12. Proof of agreement Entering the required bank details, as well as accepting these terms and conditions and the booking voucher or request, constitutes an electronic signature that has the same value between the parties as a handwritten signature. The automated records kept in the computer systems of elloha.com are kept under reasonable security conditions and are considered as proof of communications, orders and payments between the parties. The Customer is informed that his IP address is recorded at the time of booking. 13. Force majeure By force majeure we mean any event external to the parties that is both unpredictable and insurmountable and which prevents the customer or the establishment from fulfilling all or part of its obligations under the contract as usually recognised by the case law of the French courts. Each party shall not be held liable to the other party in the event of failure to perform its obligations due to force majeure. It is expressly agreed that force majeure shall suspend the parties' performance of their mutual obligations and that each party shall bear the costs resulting from such force majeure. 14. Dispute resolution These general terms and conditions of sale are governed by French law. 15. Completeness These General Conditions of Sale, the sales conditions of the reserved rate and the reservation voucher or request express all obligations of the parties. The documents constituting the contractual obligations between the parties are, in descending order of priority, the booking voucher or request (including special terms and conditions of the reserved rate) and these General Conditions. In case of conflict between the booking voucher and the general terms and conditions, the provisions appearing on the booking voucher shall be the only ones applicable to the obligation concerned. The present general Internet sales conditions may be modified and/or supplemented at any time by the establishment. In this case, the new version of the Internet general terms and conditions of sale will be posted online by the establishment. Once posted on the Internet, the new version of the Internet general terms and conditions of sale will automatically apply to all customers.
